Wine Equalisation Tax – Producer Rebates for Australian Wineries

What is the WET Producer Rebate?
The Wine Equalisation Tax (WET) Producer Rebate is one of the most valuable tax concessions available to Australian wineries.
Eligible producers may claim a producer rebate on certain sales of wine, generally up to the amount of WET paid, with a maximum rebate of $400,000 per financial year from 1 July 2026 (shared across associated entities where applicable).
Are you eligible?
For 2018 and later vintage wines, producers generally need to:
- Be the producer of the wine.
- Be liable for WET (or sell under quote where another party is liable).
- Own the source product that comprises at least 85% of the wine throughout the applicable winemaking process.
- Sell the wine under their own brand (or that of an associated entity) in retail packaging, generally 5 litres or less.
Common sales that may qualify
The rebate may be available on:
- Cellar door sales where WET is payable and all producer rebate requirements are satisfied.
- Online direct-to-consumer sales
- Wholesale sales where WET applies
- Certain applications to own use
Common traps
Many wineries miss out on rebates because:
- The 85% ownership test is not satisfied
The producer must own the source product that makes up at least 85% of the total volume of the wine throughout the winemaking process.
For wineries using grower agreements, eligibility can often still be maintained where:
- The grapes are purchased at harvest;
- Ownership transfers before processing begins; and
- The winery retains ownership throughout production.
- Wine is sold under another business’s brand
Generally, the wine must be sold under the producer’s brand or the brand of an associated entity.
- Associated entities exceed the rebate cap
Associated entities share a single annual rebate cap, so winery groups should monitor claims across all related businesses.
- Packaging requirements are overlooked
Bulk wine sales and wine not packaged for retail sale generally do not qualify for the rebate.
Practical Tip
If your winery uses contract winemaking arrangements, clear documentation is essential. The ATO places significant emphasis on who owns the grapes or source product during production, and unclear ownership arrangements can put rebate claims at risk.
Better data = Better WET outcomes
Many wineries struggle to accurately calculate WET, producer rebates and cellar door reporting because of inconsistent sales, inventory and production data. Having reliable systems and reporting in place can significantly reduce errors and improve confidence in rebate claims.
WLF’s wine industry specialists can assist with WET compliance, producer rebate reviews and winery reporting. We are also a Vinsight Partner where we help wineries turn their data into meaningful insights while ensuring key obligations such as WET are managed correctly.
